The comfort, safety, and enjoyment of our guests is extremely important to us, as is the attention to detail, and this is the reason why so many of our guests return to re-charter in the Whitsundays with us. We have many yachts, sailing or power catarmans, catering for couples or groups of up to 10.

What to bring:
The essentials to bring on your bareboat sailing charter in the Whitsundays are heaps of sunscreen, sunglasses, broad rimmed hat, swimsuit, shorts, T-Shirts, deckshoes and an old pair of sandshoes. Include a smart casual outfit for resort visits. During the cooler months include warmer trousers and a light sweater or tracksuit.

As storage is limited, use soft fabric luggage bags. Avoid wearing hard leather or black soled shoes and coconut based tanning oil. Snorkelling equipment is on board but if you prefer your own gear, bring them along with your favourite CDs.

TYPICAL ITINERARY

Here are some popular destinations that can be visited:

Sail across the Whitsunday Passage to your first nights anchorage at Nara Inlet on Hook Island. Motor down the long narrow fjord for your overnight anchorage. Opposite is a track that leads from the beach to Aboriginal Caves and further on there is a waterfall which runs after heavy rains.

The site is protected by a fence and gate which must be kept shut to keep out the goats that inhabit the island. Inside the cave admire the primitive paintings indicating that aboriginal people lived here until recently.

Cid Harbour on Whitsunday Island is a very large harbour and is one of the all weather anchorages in the area. With several sand beaches and a 1 km walking track from Sawmill to Dugong beach this is a very pleasant way to spend the day just relaxing. For those that are a little more energetic take the walk to Whitsunday Peak for a panoramic view.

Hamilton Island this is a modern resort Island with a village that has all the essentials -bakery, bottle shop, general store, chemist, local art, fashion and plenty of restaurants to choose from. Hire a golf buggy to explore the island and end your day by watching a glorious sunset from the lookout.

Whitehaven Beach - the water is an amazing emerald colour. The beach is 5 kilometres of sparkling white sand made up of 98% silica a legacy of a geologic era when the sea level was lower. Take a walk up the beach and the only sound you hear is the sand that squeaks beneath your feet. There are no resorts, no buildings, just natural beauty. At the northern end of the beach is Tongue Point with a safe anchorage in Tongue Bay.

Once ashore it is just 650 meters to the platform lookout with a magnificent view straight into Hill Inlet where the sands just beneath the water swirl to give incredible contrast. The long sweep of Whitehaven beach makes a picture for all your friends to envy.

Border Island: Cateran Bay a great place for a snorkel. The fringing reef has so much to offer. Colourful corals with an abundance of vivid fish of all shapes and sizes including the resident Moari Wrasse, a huge blue placid fish with a big pouty mouth who gracefully swims amongst the other fish.

Further north to the top end of Hook Island is Manta Ray Bay offering some of the best underwater scenery in the area. Butterfly Bay is the perfect spot to pick up a mooring, to sit back and reflect on the days events.Feed the bat fish at Cateran Bay in the Whitsunday islands

Blue Pearl Bay: on Hayman Island offers more amazing snorkelling with an abundance of fish and corals. Alternatively, spoil yourself and tie up at Hayman Island Marina and visit the resort for lunch. Be sure to have your credit card handy as this resort is simply five star, or just moor at Langford Reef for lunch before heading off to Stonehaven to pick up a free public mooring, to view another amazing sunset and settle in for the night.

Black Island: or as the brochures advertise Bali Hai. This small island is surrounded by reef and you will see a very distinctive Yellow Submarine. This is for day tours for non-snorkellers who come to this area by ferry to view the reef without getting wet. Several hours south is South Molle Island.

This is a national park and has some of the finest walking tracks with spectacular views of the Whitsunday Passage. You can visit the resort for a small fee and enjoy the facilities including a 9 hole golf course, tennis courts and swimming pool and enjoy one of their famous Island feasts.

Around the corner is Daydream Island also known as West Molle with just enough time for one last snorkel before heading back to Abel Point Marina. Each bay has its own individual beauty.  While in Tongue Bay one evening, we felt extremely privileged to see Dugongs swimming into the bay.  We were able to snorkel the coral reefs, see turtles, dolphins, aboriginal cave paintings, Whitehaven Beach (to name a few) and every evening we saw the most amazing sunsets.

We loved "our boat" Beach House;  she was beautifully presented and was perfect for us inside and out.  We would have no hesitation in recommending chartering either this yacht or any of the others that the Operator have.  The team at the Operator are extremely friendly, professional and helpful and the Abel Point Marina is a great place from which to start and finish sailing the Whitsundays.

When we left Circo back in early June we slowly drove North to Cooktown and toured for a few weeks before returning home just 3 weeks ago. Then stuff overtook us and I am sorry that I have not been able to respond to the email questionnaire till now. The more so because, apart from the weather- which we do not blame YOU for! -the week with Circo was a wonderful experience. It certainly honed our skills and the boat was a dream. Thank you all very much for a wonderful sailing holiday ! Purrfection was absolutely perfect for our needs - a spacious, luxurious, well appointed vessel with wonderful sailing capability. The Whitsundays provided an excellent venue to cater for our party's various needs - sailing, swimming, snorkelling, sleeping (the teenagers!) and sight seeing. As a first time "solo" experience it has provided me with the confidence to do further bareboat charters. John's briefing provided some simply reassuring advice which took a lot of the anxiety out of my mind - although I still got up about 4 times a night to check that the boat hadn't drifted off the 40 metres of chain !

All my family have said how much they enjoyed their holiday - my daughter wants to know when we are buying the boat - and my sons girlfriend who has not sailed before - wants to know when we are sailing again. (She did look rather anxious when John disappeared after the briefing as she had somehow thought we were hiring a skipper. The "... oh, are YOU sailing us around for the next 5 days" with a worried look on her face said it all!)

Hi Guys

Let me say first of the presentation of the boat on arrival for our holiday was 100%. And the person that gave the crew briefing (I have forgotten his name) was again very professional, he took the time to take us through the boat systems, and at the end Ross (my son) & I fully understood the workings of the vessel.

Secondly he took us through the “100 Islands” hand book, and at the end we had a very comprehensive understanding of the sailing area.

Finally he took us out into the bay and demonstrated anchoring and the tacking capabilities of the boat and I was pleased (should I say relieved) to note that we were not allowed to jybe the boat.  

To close out our briefing we discussed the better areas for snorkelling and general sailing.

Would we do it again “YES” see you next year.

The sailing area is better than the Greek Islands and the boat “Razzle Dazzle” was fantastic.

Thanks again for a fantastic 8 nights aboard the Masquerade. We all enjoyed the trip and it was exactly what we needed.

Despite the weather not being so kind to us on the first couple of days we managed to catch up on some serious fishing, little reading and a bit of eating and drinking. And once weather fined up we all had a great time swimming and exploring the Whitsunday’s. White haven beach would have to be one of the best swimming beaches we have visited.

We caught some nice fish which included a 5 klg golden trevally which fed us for a couple of nights and with the aid of some red wine this was first class.

Found manta ray bay a great spot for snorkeling as none of us had ever seen corral like this before.

The whole crew looked forward to morning and evening scheds, quite entertaining and there certainly seems to be a few characters about on some of those charter boats.

Couldn’t have asked for a better boat, Masquerade suited our group perfectly and was very well equipped and very comfortable with heaps of storage space.

Stop off at Hamilton was also an added bonus and we took time out to have a nice night out on the town and a tour around the Island on a couple of buggies.

All in all a fantastic trip, Thank you guys

Leaving the New Zealand winter behind and wanting to try boating in Australia, we headed straight for Airlie Beach.

We had a truly amazing experience - something we could not forget in a lifetime!

After a full and comprehensive briefing, including vessel operation, navigation and safety and care for the fragile local eco system by the team at the Operator we headed the catamaran 'Divocean' towards the Whitsunday Islands.

On the way we were enthralled by the antics of a pair of humpback whales slapping the waters of the Whitsunday Passage, broaching their bodies out of the water and performing water ballet with their tails protruding upright from the water for long periods. The sounds of their calls resonated through the hull at morning and evening whilst at anchor.

With magnificent corals and multi-coloured reef fish surrounding these islands the view from a snorkel and mask (gear supplied) was breath taking.

From the turtles at Butterfly Bay to the powdered white sands of Whitehaven Beach there is adventure for all ages as long as we all obey the instructions given and help protect this marine wonderland. The Operator is very pro-active in this regard and we thank them sincerely for all their help and advice and look forward to a return visit soon.

We thoroughly enjoyed our (short 5 day) charter aboard your yacht "BeachHouse".

The Whitsundays was everything and more that we ever imagined. Having travelled extensively to over 20 countries over the past year, we have seen and done some wonderful things. But, somehow nothing could ever compare to our week long charter in the Whitsundays.

Having always been into power boats (and never sailed), we thought it would be a nice change to charter a yacht for a week. We were not disappointed. We can now appreciate the sheer exhiliration that you can only get from boating with only the power of the wind in your sails and getting the salt spray on your face.

A special thank-you to Kym for giving a us such a detailed briefing before we set off. You made us feel confident and excited about the week ahead of us. All of your years of sailing experience and local knowledge, truly made our trip more fantastic!

We will definately be back soon. Hopefully we can convert more of our friends to sailing, so that they can see for themselves the beauty of the Whitsundays.

Dear John, Annie & CYA Staff,

Thank you for helping make our time sailing around the Whitsundays perfect. 'Aria' was an ideal introduction for the 2 teenage girls we had onboard, and both of them were quite handy helping with the sails, steering and tying on fenders etc whilst docking at Hamilton Island.

I don't think either girl expected to see such beautiful sights under the water and couldn't get into their suits quickly enough every time we anchored in a new place. Speaking of which, we loved Chalkie's Beach, Whitehaven of course, and yet had the most fun at Sawmill Beach in Cid Harbour and met some lovely people who gave us some fishing tips. We did manage to catch a few fantastic Coral Trout too and the girls spent hours fishing.

For Tim & I, we enjoyed the whole sailing experience - no motors, just the wind in the sails and the splash of waves as we sailed towards Border Island - just magic and we managed to maintain 3kts so not a bad effort. Afternoon drinks on the 'poop deck' didn't go astray either - we are missing that luxury now we are back home!

'Aria' was very well presented and easy to get about on and very comfortable in every way. We do have our sights set on 'Razzle Dazzle' though - John should not have shown that one to us! Wow, how impressive.

We'll be back as soon as possible and hopefully bring some newcomers with us next time.

It had been a dream of ours for many years to sail the Whitsundays. Unfortunately...we only chartered the "Aria" for one week and missed out on a few places we would of liked to see...so we are just going to have to do it all again...yippee! Only 47 and a half weeks to go!

We loved the whole Whitsunday charter experience so much that we would have no hesitation in recommending your company (and the Whitsundays) to friends and family alike.

The "Aria" was a very comfortable yacht for our small family of four and was everything we expected and more. The presentation was first class and the way we were greeted upon our arrival was comforting.

Our favourite spot was Nara Inlet...no...Butterfly Bay...hmm...Macona? Happy Bay? Cid harbour...now that was an experience... Seriously, "it was all good".

Having booked it directly and predominantly online you can sometimes be a little apprehensive as to how it will pan out but we were delighted with all aspects of the trip. The 35’ Catalina was great and the cleanest charter boat that I have had the pleasure of sailing, I was very impressed with the brief that Craig provided and is a great help for budding young sailors. We would recommend CYA to anyone who was thinking of a bareboat charter.

Our first bareboat experience couldn't have been better. Annie and John looked very well after us, right from the start, during the daily briefings and after returning the yacht. We had the luck of sailing an new Catalina 350 with the illustrious name "Upyerkilt".

We had enjoyed all the features of the yacht slept like roses in the cabins and on deck and sailed like pirates even on the last day with 35 knots wind and 3 meter seas "Upyerkilt" brought us safely back to Airlie Beach.

TERMS AND CONDITIONS FOR THIS VESSEL FOR TRAVEL BETWEEN Tue, Jan 1 2008 AND Thu, Dec 31 2015

Important information about your voyage
Prior to departure you will be required to sign a rental agreement with the Operator of this vessel. Here is a summary of the terms and conditions:

Definitions
The following definitions apply for the Terms and Conditions for this vessel.
- The Supplier or Operator means the Operator who supplies this vessel to you on arrival.
- The Client is also referred to as the renter (s) or hirer (s)

1 Interpretation:

The Operator includes the owner of the Boat, the Operator's subsidiaries, employees, directors, affiliates, agents and subcontractors appointed by the Operator. The Charterer includes the Charterer's guests, family, employees, agents and crew members. In this agreement, unless the contract otherwise requires, the singular includes the plural and vice versa, words denoting gender shall include all other gender, headings are for convenience of reference only and shall not affect construction of the agreement. Children are defined as persons under the age of sixteen years. Time is of the essence of this agreement.

2 Delivery
The Operator shall deliver the Boat at the Port of Delivery staunch, clean and in full commission ready for service. The Operator may allow credit pro rata for charter fees covering periods of delay in delivery. The Operator has the right, at its discretion, to substitute a boat of similar type or to cancel the charter and refund the charter fee. If the Operator fails to make delivery within twenty-four hours after the due time then the Charterer may cancel the agreement and a full refund of the charter fee will be paid. The Operator shall then have no further liability to the Charterer beyond that refund. The Charterer warrants that he will examine the Boat before taking delivery and by accepting the Boat shall be deemed to have satisfied himself that the Boat is staunch and properly outfitted for a yacht or motor cruiser of her type, size and accommodation. Should the Charterer not be ready to accept delivery of the Boat at the stated time for delivery for any reason the Operator has the right to set the time of delivery any time within the next twenty-four hour period. In that event there shall be no partial refund for any of the charter time lost. The charter period commences with the area briefing and boat familiarisation or sail orientation.

3 Payments, Cancellation and Bond
The booking requires a holding deposit at the time of booking, which will be processed upon confirmation. Your booking is confirmed when you receive back an email confirmation (providing there are no problems with your credit card and your vessel is available). The transaction for the outstanding balance is done 60 days prior to departure.
The Charterer shall pay:
1. Damage Waiver - non refundable as below plus $500 refundable bond.

2) All fuel used, to be paid for on return to base.
Please note: The Operator accept Visa and Mastercard and the credit card charges are - 2.25% surcharge on the deposit and a 3% surcharge on the balance payable.

Cancellation policy
In the event the Charterer cancels this agreement by notice in writing received by the Operator at PO Box 62, Airlie Beach more than 63 days prior to commencement of the charter period there will be an additional administration fee of $400. Any additional money collect above this amount will be refunded back to the client.

If 60 or less days of notice of cancellation is given the full charter fee shall remain due and payable and will not be waived or refunded unless the Operator is able to obtain an alternative booking for the same charter period. In the event of any deductions for insurance excess or consequential credit card or banking charges, demurrage, repair of any damaged or loss of equipment, or any accident, breakdown, recall or repossession of the Boat, or other costs, the balance will be posted to the Charterer as soon as is reasonably practicable once the deduction can be calculated by the Operator.

4 Inventory
At the time of delivery the Charterer shall, if requested by the Operator, complete, check and sign a record of inventory and on redelivery to attend to checking with the Operator and to countersign the record of inventory after checking. Any lost or damaged inventory item shall have all expenses relating to the loss or damage debited against the security bond. If the Operator does not require signing of a record of inventory, it's right to debit against the security bond is not waived.

5 Running Expenses
The Charterer shall pay all running expenses during the charter period including pilotage, port charges, sail guide and crew charges, service calls (excluding breakdowns not the fault of the charterer), refuelling costs, engine running costs (calculated at the termination of charter) and provisions and supplies for him and his party. The Charterer agrees to pay a fuel deposit as determined by the Operator (if applicable).

6 Competency
In this clause "competent person" means a person competent in the handling of the type of boat chartered including:
· Knowledge and practical experience of seamanship:
· Knowledge and practical experience in the handling of inboard auxiliary powered sailing craft and associated equipment of the general type and size of boat
a. The Charterer warrants that he is a competent person in the handling and operations of the type of boat chartered
b. The Charterer undertakes not to permit any other person to operate the Boat unless that person is a competent person
c. The Operator reserves the right to require the Charterer and any other person who shall operate the Boat to demonstrate to the Operator that they are competent persons. Should the Operator not be satisfied with the competency of the Charterer, the Operator may require a sailing guide on board the Boat for such period as determined by the Operator
In the event that the Charterer or any other person is considered by the Operator to be a competent person as a result of any misleading, deceptive conduct or misrepresentation by the Charterer and upon which the owner has relied to form an opinion then the Operator shall have the right to install a competent sailing guide aboard the Boat and at its election to terminate this agreement. The Operator shall have the right to recover all losses against the Charterer without any liability to refund or compensate the Charterer.

7 Navigation and Other Limits

The Charterer shall restrict the cruising of the Boat from 0800 to 1600 hours and shall limit his cruising perimeter to the area and limitation clearly defined and specified by the Operator. The Boat shall be employed exclusively as a pleasure boat for the sole and proper use of members of the Charterer's party. The Charterer shall not carry on the Boat more than the specified number in the party and the Charterer shall not permit any other party, except competent persons within the Charterer's party, to operate the Boat unless the prior written permission of the Operator is obtained. The Charterer shall not race the Boat. The Charterer shall not engage in trade including transporting merchandise or passengers for pay. No goods, documents or drugs shall be carried which would involve the risk of seizure of the Boat by any government. Pets shall not be taken on the Boat. Children must be under the control of a responsible adult. That adult is responsible for the conduct and personal safety of the children while on the Boat. The Charterer shall not allow any person on board to commit any act contrary to the laws of Australia, or of any other government within the jurisdiction of which the Boat may be at any time and shall comply with the law in all other respects. The Charterer shall not tie the Boat up at any jetties or piers except those approved by the Operator prior to the charter or make any landing with the Boat.

8 Charterer's Authority
At the commencement of the charter period the Operator shall relinquish its possession and command of the Boat to the Charterer and full authority regarding the management of the Boat and its crew or members of the Charter party shall be transferred to the Charterer for the period of this charter. Should a sailing guide be put on board either at the Charterer's request or at the Operator's option the sailing guide shall be the sole responsibility of the Charterer and the Charterer shall pay the Operator for the sailing guide at the current daily rate listed at the Operator's offices and feed and accommodate the sailing guide. If a sailing guide is put on the Boat, then although the Charterer shall have possession, command, navigation and full control over the Boat, the sailing guide is to be sole judge as to whether it is reasonable or prudent to sail at any time and as to whether any specified anchorage is reasonably safe.

9 Redelivery
The Charterer shall redeliver the Boat to the Operator free from any indebtedness which may have occurred on the Charterer's account at the Port of Return together with all of its equipment, in the same good condition as it was at delivery, save for fair wear and tear from ordinary and proper use. If for any reason other than that the Boat has become a total loss, he shall fail to redeliver the Boat at the agreed place and time, he shall pay the Operator demurrage at the rate of the charter fee per night of the Boat plus 50% for every day or part of a day ("Agreed Demurrage") until redelivery is effected. If the Charterer leaves the Boat at any place other than the Port of Return he shall pay to the Operator: all expenses involved in transferring the boat to the Port of Return; Agreed Demurrage for the number of days required for the transfer; plus any losses or damage not covered by the Operator's insurance which may occur on or to the Boat or otherwise arises from the redelivery until it has been redelivered to the Operator at the Port of Return. In the event the Charterer should elect for any reason to redeliver the boat prior to the end of the charter period the Operator shall not be liable to return any part of the charter fees. Unless otherwise approved by the Operator, the vessel must be returned and vacated by 11.00am on the return date.

10 Cleaning
If upon completion of the charter the Charterer has not left the Boat in clean and tidy condition (including the removal of al garbage) then the Charterer shall pay for the costs of cleaning the Boat.

11 Recall
Operator reserves the right to recall the Boat at any time if the weather is considered by the Operator to be a threat to safe operation or in the Operator's opinion the Boat is being improperly or incorrectly sailed, managed or controlled so as to imperil the Boat, other vessels or property or life. A recall may include but is not limited to a recall to the Operator's base or an instruction to proceed to a haven deemed to be safe for the prevailing conditions. During a recall the Charterer may be required to vacate the Boat depending on conditions. The Operator shall not be liable for any lost time, expense or losses to personal goods or property due to recall and the Operator is not liable to repay any charter fees. The Charterer is advised to take out the appropriate insurance cover for such events.

12 Service Calls
In the event of a malfunction of the Boat or its equipment, the Operator shall subject to prevailing weather conditions use its best endeavours to reach the Boat with a service call at the earliest opportunity. In the event a service call is not in the Operator's opinion reasonably possible, or if the problem cannot be otherwise rectified, the Charterer shall proceed to the point designated by the Operator where repairs or replacement, where possible, will be made. If the service call is in the reasonable opinion of the Operator due to any fault of any member of the charter party any cost incurred shall be at the expense of the charterer.

13 Replacement
In the event that a fault in the Boat is detected before or during the charter period that may cause unsatisfactory performance of the Boat or equipment, then the Operator has the right to expeditiously effect repairs. In the event the Boat is in the Operator's opinion inoperable during part of the charter period through no fault of the Charterer rendering total or premature termination of the charter, the Operator may at its option endeavour to provide as a substitute an alternative boat of similar size and quality for the charter period. If no substitute boat can be provided the Charterer shall be entitled to reimbursement of charter fees for each full day (midday to midday) of the charter, which has not been used.

14 Accident or Breakdown

In the event of any accident, loss, breakdown or disaster, the Charterer shall give immediate notice to the Operator and shall not except to the extent necessary to minimise a loss of the Boat, authorise or undertake repairs without prior authorisation of the Operator. The Charterer shall be responsible for the costs and consequence of any unauthorised repairs. The Charterer shall make no admission of liability to any party and no refund shall be made in respect of any claim arising out of such accident, loss, breakdown or disaster, save as is otherwise provided in this agreement. The Operator at its discretion shall determine if the cost of any repair, service (including cost for service vessels), breakdowns, recall or repossession or any other costs incurred by the Operator are chargeable to the Charterer and if so shall be deducted from the security bond or otherwise be owing by the Charterer.

15 Limitation of Liability
To the extent permitted by law, the liability of the Operator for indirect, special or consequential damages in connection with or arising out of the service under this agreement shall be limited to the supply of those services again. The Operator shall not be liable for any other indirect, special or consequential damages.

16 Alcohol and Drugs
The use or consumption of illegal drugs by anyone using the Operator's facilities, property or boats, either ashore or afloat is prohibited. The consumption of alcohol may increase the risk of injury around docks, water and boats and the Charterer accepts that risk. The Operator shall not be liable for any personal injury or death arising from or in any way related to the use or consumption of alcohol or illegal drugs.

17 Personal Losses
The Operator shall not be liable for loss of personal property and goods of the Charterer whilst on the Operator's property or boats.

18 Insurance
The Boat chartered is customarily insured for the charter period as protection against any accidental loss or damage that may occur, or be caused by, the Boat during the charter period as long as the Boat remains in the cruising limits and perimeters established in clause 7 and is operated in compliance in all the terms and conditions of this agreement. Any excesses in connection with claims made under the policy may be debited by the Operator against the security bond. In case of loss, accident or breakdown, or a disaster, the Charterer shall give immediate notice to the Operator and shall not except to the extent necessary to avert or minimize damage to a loss of the Boat, attempt repairs without authorisation of the Operator.

19 Insurance Limitations

The insurance cover on the Boat does not usually cover Charterer negligence. The Charterer is liable for all damages or loss caused by him or other member of the charter party arising through his or any of the Charterer's party's negligence or incurred by malicious or wilful acts of the Charterer or members of the Charterer's party. The Charterer's liability extends to the Operator and other parties to the full cost of making good any loss or damage. The Charterer acknowledges that under this agreement he is not insured for, and may be liable for damages to persons or property arising in whole or part from the negligence of the Charterer. Failure to report groundings, hull and machinery damage to the Operator at the time of the incident constitutes charterer negligence.
 
BAREBOAT HIRER'S LIABILITY INSURANCE:

This Policy is designed to protect you from claims made against you by others for Property Loss, Accidental Death, Bodily Injury or Illness to them caused by (or as a result of) your negligence. For this policy to apply to you, the hired vessel or the tender must be involved in the loss.
Please contact the Operator for current costs of this policy.
Cost -- 5nights = $60 -- 6 to 9nights = $115 -- 10+nights = $150

20 Indemnity
The Charterer shall indemnify, reimburse and hold the Operator harmless from and against any acts and all claims, losses, liabilities, demands, suits, judgement or causes or actions and all legal proceedings whether civil or criminal, penalties, fines, and other sanctions and any other costs and expenses in connection which may result from, or arise in any manner out of any matter related to this charter agreement or arise out of the management, control, encumbering use or operation of the Boat by the Charterer. No claim of any nature shall be brought against the Operator by the Charterer or any of the charter party and the Charterer agrees that he shall indemnify the Operator in respect of any amount paid by the Operator of any such claim.

21 Total Loss
Should the Boat become an actual or constructive total loss before or during the charter period, then the Operator may at its option substitute a vessel of similar type (if available) or deem this agreement to be at an end. In that event there should be no refund of any part of the charter fee. Should the boat become an actual constructive total loss before the charter period then the Operator may at its option substitute a vessel of similar type (if available) or deem this agreement to be at an end and charter fee returned.

22 Inoperable Boat
In the event that in the reasonable opinion of the Operator the Boat becomes inoperable during the Charter Period through action or inaction of the Charterer or any of his party the Operator may at its option terminate this agreement and retain all charter fees paid along with the bond. The Operator may then at its option offer a further charter to the Charterer on another vessel. The Charterer shall if he accepts the offer then pay another security deposit and all costs of the further charter including the charter fee.

23 Water Sports
The Operator and its insurance underwriters shall not be liable for accidents, injuries or death due to: swimming: windsurfing: the use of the Boat's dinghy and outboard engine: or the use of snorkels, masks, fins or scuba equipment whether supplied by the Operator or otherwise. The user of the equipment referred to in this clause must ascertain that he is experienced, qualified and capable of using the equipment and the equipment is suitable and in good condition for the purpose for which it will be used and for the person using it.

24 Radio Arrangements
The Charterer agrees to contact the Operator's base on or within such time as the Operator may at its discretion stipulate to the Charterer on each day of the charter period and furnish necessary details of the Boat's position and the Boat's intended plans for the day and intended anchorage position for that evening. In the event that the Charterer fails to so notify and contact the Operator's base within the specified time, then that Charterer shall be responsible for all costs or expenses incurred by the Operator in searching for the Charterer including but not limited to, the hire of aircraft or other means of transport.

25 Government Fees and Future Taxes
Charterer's pay a fee of $20.00 per person payable on arrival in cash for costs of the use of the Great Barrier Reef Marine Park. The Charterer shall also pay and discharge without exception all taxes, charges, assessments and outgoings and impositions relating to the charter imposed by or under federal or state law, or by federal, state or local authorities and whether on a capital or revenue basis or any other basis and even though of a novel character which may an any time be introduced during the period from execution of this agreement to the end of the charter period.

26 Non-assignment
The Charterer shall not assign or sub-charter his interest in the Boat without the prior written consent of the Operator. The Operator may assign its rights this agreement.

27 Applicable Law
Should there be any dispute relating to retention of bond moneys or any other aspect of this agreement then as a pre-condition to the commencement of any legal proceeding the charterer must submit any claim or dispute it has to the Operator in writing setting out with reasonable particularity the details of the claim or dispute. The Operator shall respond in writing to the Charterers written submissions within 14 days. In the event that the matter cannot be resolved without recourse to litigation then the dispute shall be referred to the appropriate court referred to in clause 27b.

27b Applicable Law
This agreement shall be governed by the laws of the State of Queensland and the Commonwealth of Australia and any dispute arising or relating to the agreement or the charter shall be referred to the courts of Queensland and be heard at the nearest relevant court, being the Magistrates Court at Proserpine, the District Court at Bowen or the Supreme Court at Mackay.

TRAVELING TO THE WHITSUNDAY ISLANDS

The Operator is based at Abel Point Marina, adjacent to Airlie Beach township. the Operator meet you at the marina, unload your luggage and escort you to your vessel.

AIRLIE BEACH IS ACCESSED BY
Air: Via Proserpine Airport then 1/2 Hour coach or taxi transfer, or via Hamilton Island Airport then by Fantasea Blue Ferries. Cruise Whitsunday and coach/taxi service to Abel point marina. Alternatively into Mackay Airport with connecting bus transfers or book a one way car rental with Hertz, Avis.
Car: By National Highway to Airlie Beach, turn off at Proserpine.

Coach and Train services are also available.

For a nominal boat delivery and collection charge, you can commence and complete your holiday at Hamilton Island. Private Transfers with the Operator available on request.

TRAVEL INSURANCE
When you book your bareboat sailing charter in the Whitsundays, the Operator recommend you purchase Travel Insurance to cover for losses arising from unforeseeable circumstances. Plans are available which cover the unused, non-refundable portion of the costs of the prepaid travel arrangements such as fares and charter costs. Details are available on request or consult your travel agent.

BOATING EXPERIENCE
You don't need to be a Whitbread veteran but it is preferable that at least one of your bareboating party have some knowledge of boat handling, anchoring and use of navigational aids. If you are unsure about your experience please contact the Operator. Even very inexperienced sailors can enjoy the holiday of a lifetime after some training through Windskills, located in Airlie Beach.

BRIEFINGS
On your departure day the Operator will thoroughly brief you on your vessel, the Great Barrier Reef Marine Park, the anchorages and navigating around, assist you in your itinerary and take you on a familiarisation sail. Briefings commence at 8:45 AM and usually last about 4 hours. If need be the Operator will gladly spend more time with you until you (and the Operator) feel comfortable and confident before you set sail on your holiday. the Operator can also arrange for a sail guide or skipper to be with you for a day or two at nominal cost. Twice daily the Operator conduct radio schedules with you to advise weather, your location and proposed movements. Suggested reading prior to arrival to enhance your holiday and assist planning your sailing adventure is 100 Magic Miles. This is a great souvenir of the Whitsundays and is utilised extensively during your area brief. Ask the crew about purchasing a copy prior to your arrival.

DAILY CRUISING PERIOD
The marine board permits the vessels to operate from daybreak. Please note that it is a requirement, for safety reasons, that you have anchored by 4:00 PM each day.

PROVISIONING SERVICE
If you intend to arrive in Airlie Beach on the day of your departure, the Operator recommend you utilise the provisioning service which will, from experience, minimise departure delays and afford you sufficient time to sail to your first nights anchorage. Please advise your requirements 7 days before departure. Your order will be already stowed on board before your arrival.

WHAT TO BRING
The essentials to bring on your bareboat sailing charter in the Whitsundays are sunscreen, sunglasses, broad rimmed hat, swimsuit, shorts, T-Shirts, deckshoes and an old pair of sandshoes. Include a smart casual outfit for resort visits. During the cooler months include warmer trousers and a light sweater or tracksuit. As storage is limited, use soft fabric luggage bags. Avoid wearing hard leather or black soled shoes and coconut based tanning oil. Snorkelling equipment is on board but if you prefer your own gear, bring them along with your favourite CDs.

OTHER SERVICES
The Operator will be pleased to assist with or arrange local accommodation, scuba and sailboard hire as well as Great Barrier Reef trips, scenic flights and car parking.

INSURANCE

The Operator strongly suggest you take out travel insurance to cover yourself against the unexpected.

SAILING EXPERIENCE
Although the Operator does not require skippers to have any formal certificates or licences to charter the bareboats, you will require basic boat handling skills. You must be capable of operating the vessel safely and need to tell the Operator if you have any medical conditions which may affect your ability. You will have a very thorough briefing on the first day of your charter, (up to 4 hours) which will cover the following:
* operating your vessel, all systems and safety equipment
* cruising area, navigation, tides and weather
* Great Barrier Reef Marine Park rules and regulations
* sail and/or drive instruction for you and your crew. If you need or would like extra tuition the Operator can arrange to have your briefer spend extra time with you @ $38.50 per hour
In order to determine your level of experience the Operator will require you to fill out an Experience Questionnaire. See Clause 6 of the Charter Agreement:

 Clause 6 Competency

In this clause "competent person" means a person competent in the handling of the type of boat chartered including:

· Knowledge and practical experience of seamanship: 

· Knowledge and practical experience in the handling of inboard auxiliary powered sailing craft and associated equipment of the general type and size of boat

a. The Charterer warrants that he is a competent person in the handling and operations of the type of boat chartered

b. The Charterer undertakes not to permit any other person to operate the Boat unless that person is a competent person

c. The Operator reserves the right to require the Charterer and any other person who shall operate the Boat to demonstrate to the Operator that they are competent persons. Should the Operator not be satisfied with the competency of the Charterer, the Operator may require a sailing guide on board the Boat for such period as determined by the Operator

In the event that the Charterer or any other person is considered by the Operator to be a competent person as a result of any misleading, deceptive conduct or misrepresentation by the Charterer and upon which the owner has relied to form an opinion then the Operator shall have the right to install a competent sailing guide aboard the Boat and at its election to terminate this agreement. The Operator shall have the right to recover all losses against the Charterer without any liability to refund or compensate the Charterer.

RESTRICTION
Pets and smoking are not allowed on boats.
Vessel cruising limits vary depending on its survey and will be discussed at the time of briefing.
Late returns are at the discretion of the Operator and subject to availability. Normally no fee applies.

On very rare occasions, a rate may be displayed incorrectly due to our, or a supplier's error. In such a case, if you book with us at a quoted rate that is incorrect, we will notify you of any price change and give you the option to proceed or cancel. We make every effort to keep information on our site up to date, but we cannot guarantee this website is free of errors or omissions and retain the right to update or change the information published at any time.

Liability
To the extent permitted by law we/the owners of this website will not be liable to you or to any third party (whether in contract, tort, or otherwise) for any direct, indirect or consequential loss or damage (including but not limited to any accident, injury, delay or loss of enjoyment) arising out of your reliance upon information contained on this website, including but not limited to your use (or inability to use) any products or services described or procured through this website.

On departure day, before you commence your trip, you may be required to sign a rental agreement (in the case of boat charters) with the supplier of the vessel. Your rental and use of the vessel will be governed by the terms of the rental agreement and any other documentation or information provided to you by the supplier at the time you pick up your vessel. The rental agreement is between you and the supplier and we will not be liable to you or to any third party in relation to the terms of the supplier rental agreement or any other documentation provided to you by the supplier at the time of pick up.

While we will make reasonable efforts to ensure we are representing only reputable suppliers, we make no warranty about the fitness or suitability of any third party (supplier) product or service and will not accept responsibility for the quality or fitness of any vessel. We welcome feedback from our customers on their experience with our suppliers. We may, at our discretion, provide you with reasonable assistance in resolving any dispute you may have with a supplier.

Our total liability to you in relation to your use of this website and the information contained on this website will not exceed the dollar amount of the deposit we have received from you in relation to your booking/rental. Refunds will not be made for bookings cancelled due to inclement weather. Again, we strongly recommend that you take out travel insurance. Your use of this website is governed by the laws of New Zealand and the jurisdiction of the New Zealand courts.

Booking information
To make a booking, you must complete our no-obligations reservations enquiry form which is easy to follow and secured with the latest encryption technology. Once we receive your enquiry, we will contact you via phone or email, to advise of availability and confirm the final price is correct - and discuss payment options. A booking is confirmed when you have been emailed a confirmation notice and at this stage the deposit is processed on your credit card and becomes non-refundable and any cancellation fees stated in the terms apply. Upon receipt of your confirmation, please check your details carefully and notify us immediately if there are any incorrect details, as it may not be possible to make changes at a later date.

Please note we accept Visa and Mastercard and the credit card fees are: 
1) 1.75% for the deposit amount.
2) 1.75% for the balance of payment.

If you are booking via phone, please first make sure you have read the terms and conditions of your selected sailing adventure. Our reservations consultant will ask you if you have read the terms and agree to them before proceeding. The onus is always on the renter to ensure they make themselves fully aware of the terms displayed on our website.

Information disclosure
In booking on this website you acknowledge that we disclose your information to your selected Supplier in order to provide the requested rental, trip or charter services.

Amendments
Please check the terms of each vessel to see whether amendment fees apply. Please also note that for some vessels an amendment is treated as a new booking and the rate current at the time the amendment is made to recalculate the entire booking amount (not just the days changed). In the case of boat rental/yacht charter, if the hire or number of days is increased, an additional deposit may be required, while reduction in rental periods or price may reduce the total, but the deposit amount will remain unchanged.

Vessel Capacity and fitness to charter (for Bareboats only)
Under no circumstances are you permitted to carry more passengers than the vessel you charter is legally registered to carry, and if you do your insurance may be invalidated. The number of passengers allowed is indicated next to each vessel on this website. It is your responsibility to choose a journey that is within your capabilities. A boat or trip supplier can refuse to hire a vessel to any person who is in their opinion unfit to skipper or does not meet eligibility requirements. In such circumstances we will have no further liability to you.
